Terms of Service (Mobile App)

These Terms govern your use of the Soil Moisture Sense mobile application (the "App") and related services. By using the App, you agree to these Terms.

1. Who can use the App

You must be at least 16 years old.
You must use the App only within the permissions granted to you (e.g., by your organisation).
If you use the App on behalf of an organisation, you confirm you have authority to do so.

2. Accounts and access

Access is typically controlled by invitation and authentication.
You are responsible for maintaining the confidentiality of your login credentials.
You must notify us promptly if you suspect unauthorised access.

3. Acceptable use

You agree not to:

Attempt to access data you are not authorised to access.
Interfere with or disrupt the service (including excessive requests or attacks).
Reverse engineer or attempt to extract source code except to the extent permitted by law.
Upload unlawful content or use the App in a way that violates applicable law.

4. Data and content

You (or your organisation) retain ownership of your data.
You grant us a licence to process your data solely to provide and improve the service.
You are responsible for the accuracy of any manual data you enter.

5. Important agricultural / irrigation disclaimer

The App may display sensor readings, calculations, recommendations, or data summaries. You remain responsible for farm management decisions, including irrigation scheduling and crop care.

Sensor readings can be affected by installation, calibration, connectivity, environmental conditions, and equipment faults. Always use professional judgement and, where appropriate, independent verification.

6. Availability and changes

We aim to keep the App available, but we do not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue features to maintain security or improve the service.

We do not guarantee any specific uptime, availability level, or response time unless expressly agreed in writing under a separate agreement.

Force majeure

We are not responsible for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to cloud provider failures, internet or telecommunications outages, extreme weather events, acts of government, industrial disputes, or other external disruptions.

7. Fees (if applicable)

If your organisation pays for the service, fees and commercial terms may be governed by a separate agreement. These Terms still apply to individual users.

8. Termination

We (or your organisation) may suspend or terminate access if you breach these Terms or for security reasons.
You may stop using the App at any time.
On termination, access to data may be managed by your organisation's administrators.

9. Liability

Nothing in these Terms limits liability that cannot be limited under law (including for fraud or death/personal injury caused by negligence).

Subject to the above, to the maximum extent permitted by law:

We are not liable for indirect or consequential losses.
We are not liable for losses arising from farm management decisions made using the App.
We are not liable for losses caused by factors outside our reasonable control (e.g., network outages, third-party service disruptions).

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the App shall not exceed the amount paid by your Organisation (if any) for use of the App in the 12 months preceding the event giving rise to the claim.

The App is provided on an "as available" basis. Except as expressly stated in these Terms or in a separate written agreement, we make no warranties, representations, or guarantees (express or implied) regarding the accuracy, reliability, availability, or fitness for a particular purpose of the App.

While we implement reasonable technical and organisational measures to protect data, we do not guarantee that the App will be free from data loss, corruption, or interruption. Users and Organisations remain responsible for maintaining appropriate backups where necessary.

10. Intellectual property

The App and its content (excluding your data) are owned by or licensed to Soil Moisture Sense Ltd.
You may not copy, distribute, or create derivative works except as permitted by law.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction (unless mandatory consumer laws apply otherwise).

We may update these Terms from time to time. The latest version will always be posted at this URL and the "Last updated" date will be revised.
